Helloooo

gavster certainly has produced an extensive list to check the Eos when it is first bought!!!! In fact i wonder how long checking that list takes in total????


However what are the rights to reject the car if the car is say foul of certain points?

ie not metallic paint or other factors. what are your legal rights and in what circumstances can they be actioned.

As far as i know and correct me if im wrong if you leave forecourt you have agreed it is of sound quality and fit for purpose or am i wrong.....?????

Warning: This is based on UK lawand anyone considering it should take advice.

If it is the wrong colour / spec you don't reject it. You don't accept it in the first place.

Rejection comes in if you take the car and go back later with issues. It would be difficult to reject a car based on wrong colour if you had not raised it at the time of delivery.

You have to give the dealer reasonable chance to fix the faults and if he cannot you can reject the car, it also needs to happen within a reasonable time of taking delivery (reasonable means the courts make the final decision)

Other wise all covered by Sale of Goods (& Services) Act - Google it.

Its the "reasonable" time/chance to fix problems that is a pain in the butt here! We don't have a "lemon" law, which I'm sure there was something in the news about the chance of this being introduced, but that was a couple of years ago - something like 3 major faults and the car can be rejected. Still waiting for that!:D

I rejected my Eos when it was 5 weeks old. It had spent 13 days at the garage being repaired, damaged and then repaired again and probably 50% of the parts were replaced.

I was lucky that my dealer agreed that I could reject my Eos in August and I am now waiting for my replacement (apparently it is being built this week so I should get it in November). While I am waiting, my dealer is allowing me to drive the rejected Eos which is fine by me!

In the UK, goods should, by statute, be free of minor defects at delivery too - onus is on dealer to establish that it was free of those defects. There is no requirement for 3 major defects to have appeared before right to reject arises.

The difficulty in the UK is that each case is looked at on it's merits/facts and so if the dealer disputes your rejection it can be a long hard road to getting your cash back. You require to advise of your rejection and ask him to uplift the car and refund your cash and if he doesn't you then need to take the car back and sue for your cash. In other words you have no car and no cash !! legal action can take up to two years - one chap in Scotland got money back on his Land Rover after 2 years but did not recover all of his (£50K!!) legal costs. Moral ? Hope the dealer sorts your issues out to your satisfaction !!

k and on delivery is it usual practice for the dealer to spend 5 mins with you as you check everything, or do they just hand u keys and just disappear. the only thing that worries me is not telling the difference between solid black and metalic black which is what i ordered.

I wonder how long gavs list takes?? to check
